Gouvernance foncière face à l’urgence de la réforme à N’Djamena, cité-capitale du Tchad

Résumé

La gouvernance foncière à N’Djaména fait face à une urbanisation rapide, à une forte pression sur le sol et à une multiplication des conflits liés à l’accès à la terre. Dans un contexte marqué par la coexistence de normes coutumières et de dispositifs étatiques insuffisamment articulés, cette recherche analyse les mécanismes par lesquels la fragmentation juridique, institutionnelle et informationnelle alimente l’insécurité foncière dans la capitale tchadienne. L’étude vise à identifier les principaux dysfonctionnements du système foncier urbain, à examiner les perceptions des acteurs vis-à-vis des réformes engagées et à mettre en évidence les conditions d’une sécurisation durable des droits fonciers. La recherche repose sur une approche qualitative fondée sur des entretiens semi-directifs réalisés entre avril 2025 et février 2026 auprès de onze acteurs clés issus des administrations foncières, des collectivités territoriales, du secteur privé, de la société civile et d’un partenaire technique. Les données ont été traitées par analyse thématique de contenu. Les résultats révèlent un système foncier profondément fragmenté, marqué par l’obsolescence du cadre juridique, la dispersion des compétences, l’absence d’interopérabilité des systèmes d’information et la faiblesse des mécanismes de coordination. Les conflits fonciers traduisent un pluralisme normatif peu régulé, aggravé par l’urbanisation anarchique, les doubles attributions et les limites du système judiciaire. L’étude met également en évidence les inégalités d’accès au foncier et la marginalisation de certains acteurs. Elle souligne enfin la nécessité d’une gouvernance foncière plus intégrée, inclusive et transparente, fondée sur la reconnaissance des droits légitimes et une meilleure coordination institutionnelle. La contribution de cet article réside dans une lecture intégrée de la gouvernance foncière urbaine, articulant dimensions juridiques, institutionnelles, sociales et spatiales.

Abstract

Land governance in N’Djamena is confronted with rapid urbanization, increasing pressure on land resources, and a growing number of conflicts related to land access. In a context characterized by the coexistence of customary norms and poorly coordinated state mechanisms, this study analyzes the ways in which legal, institutional, and informational fragmentation contributes to land tenure insecurity in the Chadian capital. The research aims to identify the major dysfunctions affecting the urban land system, examine stakeholders’ perceptions of ongoing reforms, and highlight the conditions necessary for the sustainable securing of land rights. The study adopts a qualitative approach based on semi-structured interviews conducted between April 2025 and February 2026 with eleven key stakeholders drawn from land administration agencies, local authorities, the private sector, civil society organizations, and a technical partner. The collected data were analyzed using thematic content analysis. The findings reveal a deeply fragmented land system characterized by an outdated legal framework, fragmented institutional responsibilities, the lack of interoperability between land information systems, and weak coordination mechanisms. Land disputes reflect poorly regulated normative pluralism, further exacerbated by uncontrolled urban expansion, multiple land allocations, and the limitations of the judicial system. The study also highlights inequalities in access to land and the marginalization of certain actors within land governance processes. Finally, the research underscores the need for a more integrated, inclusive, and transparent land governance framework based on the recognition of legitimate rights and stronger institutional coordination. The main contribution of this article lies in its integrated analysis of urban land governance, combining legal, institutional, social, and spatial dimensions.
